Terms and Conditions for Focus Pad

1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and the owner of Focus Pad (“we,” “us,” or “our”). By accessing the Focus Pad mobile application (the "Application"), you agree that you have read, understood, and accepted these Terms.

If you do not agree to these Terms, you must discontinue use of the Application immediately.

We may update these Terms at any time. Updates will be reflected through the "Last Updated" date above, and you are encouraged to review this page periodically.

2. Intellectual Property Rights

The Application and all associated content, including source code, software, designs, graphics, and trademarks, are owned or licensed by us. You may not copy, republish, distribute, or exploit any content for commercial purposes without written permission.

3. User Representations

By using the Application, you certify that:

• You are legally capable of agreeing to these Terms.
• You are not a minor in your jurisdiction.
• You will not use bots or automated tools to access the Application.
• You will not use the Application for illegal or unauthorized purposes.
• Your use will comply with all applicable laws.

4. User-Generated Content

You may create and store content such as lists and reminders (“User Content”). All User Content is stored locally on your device. We do not access or store it on our servers.

You are responsible for ensuring your User Content does not violate laws or infringe rights. We are not responsible for loss or corruption of your User Content.

5. Prohibited Activities

You agree not to:

• Extract data from the Application to build any database or directory.
• Upload or create illegal, defamatory, or infringing content.
• Bypass, disable, or tamper with security features.
• Use automated tools like bots or scripts.
• Disrupt or overload the Application or connected networks.
• Impersonate others.
• Reverse-engineer any part of the Application.
• Use the Application to compete with us or generate revenue.

6. Third-Party Services

The Application may use third-party services, including Google Firebase for analytics and crash reporting. These services operate under their own policies. Your User Content is never shared with them.

7. Application Management

We may monitor and manage the Application to ensure compliance and protect our rights. We may restrict or disable access at our discretion.

8. Term and Termination

These Terms apply as long as you use the Application. We may suspend or terminate your access at any time for violations, without notice or liability.

9. Modifications and Interruptions

We may update or discontinue the Application at any time. We are not liable for interruptions caused by maintenance, issues, or other factors.

10. Disclaimer of Warranty

The Application is provided "as is" and "as available." We disclaim all warranties, including implied warranties of merchantability and fitness for a particular purpose.

11. Limitation of Liability

We are not liable for any damages resulting from use of the Application, including loss of data, revenue, or profits.

12. Indemnification

You agree to indemnify and hold us harmless from any claims arising from your User Content, actions, or violations of these Terms.

These Terms are governed by the laws of our jurisdiction, without regard to conflict of law principles.

14. Dispute Resolution

All disputes must first be attempted to be resolved informally for 30 days before arbitration.
